End User License Agreement (EULA)

This End User License Agreement ("EULA") is a legal agreement between you ("User" or "You") and Silviu Petrescu] ("Company", "We", or "Us") governing your use of the Practice of Happiness mobile application (the "App"), including any related services provided through the App (the "Service").

By downloading, installing, or using the App, You agree to be bound by the terms and conditions of this EULA. If You do not agree to the terms of this EULA, do not download, install, or use the App.

1. License Grant

The Company grants You a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes, subject to the terms of this EULA.

2. Subscription Services

The App allows You to subscribe to certain services (the "Subscription Service"). Your subscription to the Subscription Service is governed by the following:

2.1 Subscription Fees

The Subscription Service may require a payment of a recurring fee, which will be clearly displayed during the subscription process. By subscribing, You agree to pay the applicable fees, which may vary depending on the subscription plan You select.

2.2 Billing

The subscription fee will be billed automatically on a recurring basis (e.g., monthly or annually), depending on the plan chosen, to the payment method You provide. You are responsible for keeping your payment information current and ensuring that sufficient funds are available at the time of each billing cycle.

2.3 Free Trials and Promotional Offers

The Company may offer free trials or promotional offers at its sole discretion. Any such offers are subject to change or cancellation at any time without notice.

2.4 Automatic Renewal

Your subscription will automatically renew at the end of the subscription period unless canceled in accordance with Section 2.6. You authorize the Company to charge your payment method for the renewal term.

2.5 Changes to Subscription Plans

The Company reserves the right to change the pricing and features of the Subscription Service. You will be notified in advance of any material changes, and You will have the opportunity to cancel your subscription before such changes take effect.

2.6 Cancellation

You may cancel your subscription at any time through the App or by contacting customer support at contact@practiceofhappiness.app. If You cancel, your access to the Subscription Service will continue until the end of the current billing period, after which it will terminate. No refunds will be provided for the remainder of the billing period following cancellation.

3. Ownership and Intellectual Property

The App, including all content, features, and functionalities, is the property of the Company or its licensors and is protected by copyright, trademark, and other applicable intellectual property laws. You agree not to copy, modify, distribute, reverse-engineer, or otherwise misuse any part of the App.

4. Restrictions on Use

You agree not to:

  • Use the App for any unlawful purpose.

  • Use the App to infringe on the rights of any third party.

  • Modify, decompile, or reverse-engineer the App.

  • Use automated means (e.g., bots) to access the App.

  • Transfer or sublicense your license to use the App to any other person or entity.

5. Privacy and Data Collection

We may collect, use, and share your data in accordance with our Privacy Policy, which is incorporated by reference into this EULA. By using the App, You agree to our collection and use of your information as described in the Privacy Policy.

6. Term and Termination

This EULA is effective from the date You download or use the App and will continue until terminated. The Company may terminate this EULA at any time without notice if You breach any provision of this EULA. Upon termination, You must stop using the App and delete it from your device.

7. Disclaimer of Warranties

The App and Subscription Service are provided on an "as-is" and "as-available" basis without warranties of any kind, either express or implied. The Company does not warrant that the App will be error-free, secure, or uninterrupted.

8. Limitation of Liability

To the maximum extent permitted by applicable law, the Company will not be liable for any direct, indirect, incidental, or consequential damages arising out of or relating to your use of, or inability to use, the App or Subscription Service, even if the Company has been advised of the possibility of such damages.

9. Indemnification

You agree to indemnify and hold harmless the Company, its affiliates, and licensors from any claims, damages, liabilities, costs, or expenses arising from your use of the App or Subscription Service or your violation of this EULA.

10. Governing Law

This EULA shall be governed by and construed in accordance with the laws of Romania. Any disputes arising under or in connection with this EULA shall be subject to the exclusive jurisdiction of the courts located in Romania.

11. Changes to this EULA

The Company reserves the right to modify this EULA at any time. If changes are made, We will notify You by posting the updated EULA within the App or through other communication methods. Your continued use of the App after such changes constitutes your acceptance of the updated EULA.
